Truck Application Terms and Conditions

By applying to operate a truck with Pamir Logistics, you (the applicant, referred to as "Driver" or "Truck Owner") agree to abide by the following terms and conditions:

1. Eligibility and Licensing

  • Driver Qualifications: To be eligible to operate a truck under the employment of [Your Company Name], the Driver must possess a valid Commercial Driver's License (CDL) appropriate for the class of truck they will operate. The Driver must also comply with all federal, state, and local laws and regulations.

  • Age Requirement: The Driver must be at least 21 years of age.

  • Driving Record: The Driver must provide an acceptable driving record, free from major violations, such as DUI, reckless driving, or other serious offenses, as determined by [Your Company Name].

2. Truck Requirements

  • Truck Condition: The truck being used must be maintained in good working condition, meeting all state and federal safety requirements, including but not limited to brakes, tires, lights, and any other necessary equipment. The truck must undergo regular maintenance and be inspected as required by law.

  • Insurance: The truck must be covered by valid commercial vehicle insurance with appropriate liability, cargo, and vehicle coverage. Proof of insurance must be provided to [Your Company Name] before operating the vehicle.

  • Modifications and Equipment: Any modifications made to the truck, including specialized equipment, must be disclosed to [Your Company Name]. Modifications should meet all applicable safety standards.

3. Driver Responsibilities

  • Compliance with Laws: The Driver agrees to adhere to all applicable federal, state, and local laws, including hours-of-service regulations, weight restrictions, and traffic laws.

  • Log Books & Records: The Driver agrees to maintain accurate log books or electronic logs of driving hours, rest periods, and other required information, and provide these records to [Your Company Name] upon request.

  • Safety: The Driver agrees to operate the truck in a safe manner and immediately report any incidents, accidents, or vehicle malfunctions to [Your Company Name].

  • Substance Abuse: The Driver must not operate the vehicle under the influence of alcohol, drugs, or any other substances that impair driving ability. Random drug and alcohol testing may be conducted as required by law.

  • Reporting Violations: The Driver must immediately report any traffic violations, accidents, or damage to the truck to [Your Company Name].

4. Payment & Compensation

  • Payment Terms: Payment for services will be made as outlined in the agreement between [Your Company Name] and the Driver/Truck Owner. This may include pay per mile, flat-rate pay, or other compensation structures.

  • Owner-Operator Compensation: If the truck is owned by the Driver, the Driver will receive compensation for the use of their truck in accordance with the agreed-upon terms.

  • Expenses: The Driver is responsible for any costs related to the truck's operation (fuel, maintenance, tolls, etc.), unless otherwise specified in the agreement.

  • Withholding Taxes: Drivers working as independent contractors may be responsible for their own taxes, including income tax, Social Security, and Medicare contributions, as required by federal and state law.

5. Insurance and Liability

  • Liability: [Your Company Name] will not be liable for any injuries, accidents, or damages resulting from the Driver’s operation of the truck, unless caused by the company's direct negligence. The Driver agrees to hold [Your Company Name] harmless for any such incidents.

  • Insurance Claims: In the event of an accident or damage to the truck or cargo, the Driver must cooperate fully with the investigation and insurance claims process.

6. Termination and Disqualification

  • Disqualification: If the Driver's CDL or the truck’s registration or insurance becomes invalid, or if the Driver is disqualified from operating a commercial vehicle, [Your Company Name] may immediately suspend or terminate the agreement.

  • Return of Equipment: Upon termination or at the request of [Your Company Name], the Driver must return any company-owned equipment or materials and ensure that the truck is in a condition to be safely returned to the company or used for other assignments.

7. Confidentiality and Non-Disclosure

  • The Driver agrees to keep confidential any proprietary information, business strategies, customer data, or other confidential materials belonging to [Your Company Name], both during and after the term of the agreement.

8. Indemnification

  • The Driver agrees to indemnify and hold [Your Company Name] harmless from any claims, damages, losses, or expenses arising from the Driver’s actions, including accidents, traffic violations, or other misconduct while operating the truck.

9. Dispute Resolution

  • In the event of a dispute between the Driver and [Your Company Name], both parties agree to seek resolution through mediation or arbitration before pursuing any legal action.

10. Governing Law

  • These terms and conditions shall be governed by and construed in accordance with the laws of the state in which [Your Company Name] is based, without regard to its conflict of law principles.

11. Miscellaneous

  • Modification of Terms: [Your Company Name] reserves the right to amend or modify these terms and conditions at any time, with written notice to the Driver.
