Pamir Logistics - Driver Application Terms and Conditions (USA)
By submitting an application to become a driver with Pamir Logistics, you acknowledge and agree to the following terms and conditions. These terms govern your application process, eligibility, and responsibilities as a driver within the United States.
1. Eligibility Requirements
To apply as a driver with Pamir Logistics, you must meet the following eligibility criteria:
Age: You must be at least 21 years old.
Valid Commercial Driver's License (CDL): You must hold a valid CDL appropriate for the type of vehicle and freight you intend to drive.
Clean Driving Record: You must have a clean driving record with no major traffic violations or accidents. Your driving history will be reviewed during the application process.
Work Eligibility: You must be legally eligible to work in the United States and provide proof of eligibility.
Experience: You must have a minimum of 2 years of verifiable driving experience (or more, depending on the type of freight).
Medical Examination: You must pass a DOT (Department of Transportation) medical examination and have a valid medical certificate.
Drug Testing: You must pass a pre-employment drug screening in compliance with Federal Motor Carrier Safety Administration (FMCSA) regulations.
2. Application Process
Document Submission: You will be required to submit the necessary documents, including your CDL, proof of medical certification, proof of insurance (if applicable), and any other documents requested.
Background Check: Pamir Logistics will conduct a background check including a review of your motor vehicle record (MVR) and criminal history. Approval is contingent on a satisfactory background check.
Drug & Alcohol Screening: You will be required to undergo a pre-employment drug and alcohol screening as well as random testing throughout your tenure, as required by FMCSA regulations.
3. Driver Agreement
Upon acceptance of your application, you will be required to sign a Driver Agreement outlining:
Your compensation structure.
Your responsibilities regarding safety, compliance, and conduct.
Detailed expectations for your relationship with Pamir Logistics as either an employee or independent contractor (depending on your classification).
4. Compensation and Payment Terms
Pay Structure: Compensation may vary based on the type of load, distance, and the route you take. You will be informed of the specific payment terms and rates for each load before accepting a job.
Payment Schedule: Payment will be processed on a [weekly/bi-weekly/monthly] basis, depending on the terms agreed upon in your driver agreement.
Deductions: Deductions for taxes, benefits, and other applicable fees may be made from your pay based on your classification as an employee or independent contractor.
5. Driver Expectations and Responsibilities
By applying as a driver, you agree to:
Compliance with Laws: You must comply with all federal, state, and local laws governing commercial driving and transportation, including FMCSA regulations.
Safe Driving Practices: You are responsible for maintaining a high level of safety and professionalism at all times while operating any vehicle provided by Pamir Logistics.
Load Handling: You must ensure that your cargo is properly secured, and you are responsible for the safety of the load during transport.
Reporting Incidents: You must report any accidents, injuries, damages, or violations immediately to Pamir Logistics management.
Professional Conduct: You must maintain a professional and respectful demeanor when dealing with clients, shippers, and others in the logistics chain.
6. Equipment and Vehicle Use
Company-Owned Vehicles: If Pamir Logistics provides a vehicle, it must be used solely for business purposes. You are responsible for keeping the vehicle clean, safe, and in good working order, and you must adhere to any maintenance schedules provided by the company.
Personal Vehicles: If you are using your personal vehicle, you must ensure it meets all necessary safety and compliance requirements. You must also provide proof of insurance and undergo any required inspections.
7. Term of Agreement
Your agreement with Pamir Logistics will begin once you are hired and will remain in effect as long as both parties adhere to the terms set forth in the Driver Agreement. Either party may terminate the agreement at any time, subject to the terms outlined in your agreement, with or without cause.
8. Confidentiality
As a driver, you may have access to confidential company and client information. You agree to maintain the confidentiality of all such information both during and after your employment with Pamir Logistics, and you will not disclose any sensitive information to third parties without proper authorization.
9. Non-Compete and Non-Solicitation
You agree not to solicit Pamir Logistics’ clients, shippers, or employees for personal business purposes, either during your tenure or for a period of [6 months] following the termination of your relationship with Pamir Logistics (specific terms as outlined in your Driver Agreement).
10. Indemnification
You agree to indemnify and hold Pamir Logistics harmless from any claims, losses, or liabilities arising from your failure to adhere to the terms of this agreement, or as a result of your actions or negligence during the performance of your duties.
11. Changes to Terms
Pamir Logistics reserves the right to modify or update these terms and conditions at any time, in compliance with industry regulations, company policy, or changes in the law. You will be notified of any material changes, and your continued employment or contractor status indicates your acceptance of any updated terms.
12. Governing Law
These terms and conditions are governed by the laws of the State of Utah and the applicable federal laws of the United States.
